BOOKING CONDITIONS
Your contract is concluded with Vision Academy of Jovana Tomasevica 25/27, 85000, Bar, Crna Gora, Montenegro, company number IBAN ME25575025010001144878. Your contract includes these Booking conditions, and by placing an order with us you confirm your acceptance of these Terms reservation.
It is important that you read the following Booking Conditions carefully, as they form the basis of your contract with VISION ACADEMY DOO BAR. Please disconnect them and keep your travel documents with you.
Definitions
(a) References in the Booking Conditions to the “Date of Arrival” mean the date we agreed to provide services.
(b) References to “you” and “your” mean the persons indicated on the reservation (including any person or persons added or replaced subsequently).
(c) “We” “Us” and “Our” means the vision of the academy .
(d) References to “arrangements,” “trips,” or “holidays” mean services that we have agreed to provide or will provide to you in accordance with your reservation with us.
1 your holiday contract
1.1 When making a reservation, you agree that you have the authority to accept and accept on behalf of the party indicated in your reservation the terms of these Booking Conditions. The person making the reservation (“Party Leader”) must be at least 18 years old and authorized by all persons indicated in the reservation, as well as the parent or guardian of all group members under the age of 18 when the reservation is made. The party leader on his own behalf and each party member agrees to the use of information in accordance with our privacy policy.
1.2 The party leader is responsible for all payments due to us and for the reservation. All group members indicated in the reservation are jointly and severally liable for all payments due on the reservation.
1.3 The contract will exist as soon as we issue a receipt confirming the reservation to the Party Leader. The contract is subject to the terms of these Booking Conditions, which are governed by English law and the jurisdiction of the English courts. You can choose the law and jurisdiction of Scotland or Northern Ireland if you want to do so if you live in Scotland or Northern Ireland.
1.4 After receiving a confirmation of your reservation, please check this carefully. If any of the information contained in the booking confirmation receipt is incorrect or incomplete, please notify us immediately in writing, as it may not be possible to make later changes to it. We do not accept any responsibility if within 7 days from the receipt of the receipt on the confirmation of the reservation you were not informed of any inaccuracies.
1.5 We reserve the right to refuse a reservation at our sole discretion without specifying reasons for this.
1.6 You will be asked to fill out a participant form before starting a yoga retreat. If we do not receive the completed Participant Form from you before the arrival date, you will not be able to participate in any yoga retreat or in any of the yoga classes, in which case we withhold the amount paid and are not responsible for any losses. or compensation arising.
2 special requests
If you have a special request, please inform us at the time of booking. We cannot guarantee that the request will be satisfied, and any refusal to do so will not be a violation of the contract on our part. Confirmation that a request has been made will be included in the booking confirmation receipt or after the booking is confirmed. We can not accept orders that are due to the fulfillment of a special request, and we will consider it as a standard reservation.
3 Prices
3.1 We reserve the right to change the prices of any of the holidays indicated on our website. You will be informed of the current price of the vacation you want to book before confirming your contract.
3.2 The full cost of your trip must be made at the time of booking. If your booking date is more than 90 days before the date of your arrival, we accept a 30% deposit, and the balance must be paid 90 days before the date of your arrival. The rest of the cost of your trips must be paid by the date indicated on the booking confirmation receipt for your deposit. If the deposit and / or balance is not paid on time, we will cancel your trip. If the balance is not paid on time, we will save the deposit. If you book your vacation 90 days or less before the date of arrival, the full amount is paid at the time of booking.
3.3 Unless otherwise specified, the price of your travel agreement includes, without exception, all of the components described in the booking confirmation receipt.
3.4 Your trip price does not include travel insurance, excess baggage fees, gratuities and any food or drink, as well as additional excursions or activities that are not confirmed as part of your arrangements. In addition, any items or services purchased on board are not included in the price of your trip, unless otherwise indicated.

• the cost of transportation, due to the cost of fuel or other energy sources;

3.6 You may be charged for any increase in accordance with this paragraph, plus an administrative fee of £ 1 per person. However, if this means that you will have to pay an increase of more than 8% of the total cost of your confirmed travel agreement (excluding any insurance premiums, change fees and / or additional services or travel conditions), you will have the opportunity (i) accept the price increase and pay the requested amount (ii) accept the change on another trip if we can offer it (if it is equivalent or higher quality, you will not have to pay more, but if it is of lower quality you will be returned the difference in price) or (iii) canceling your travel agreement and receiving a full refund of all cash paid to us,excluding any insurance premiums and any fees for making changes and / or additional services or trips that are not part of your package. 3.7 If the price of your travel agreement decreases due to the changes mentioned above, you will be paid any payment due to you. However, please note that the travel conditions that are purchased in local currency and some obvious changes do not affect the price of your trip due to the availability of contractual and other protection measures.
4 If you change the order
4.1 If, after we send you a receipt confirming your reservation, you want to change the conditions of your trip, we will do our best to make these changes, although this is not always possible. Your request to change your reservation must be made in writing by the Party Leader. You will be asked to pay an administration fee of GBP 50 and any additional costs that we may incur when making this change. If you change your travel agreement, the price will be based on the price applied at the date you made the change. The price may not be the same as with the first booking.
4.2 If you or any member of your group is prohibited from traveling, this person may transfer his seat to someone else subject to the following conditions: a) This person is represented by you and satisfies all conditions applicable to the booked trip. b) We are notified in writing of the transfer request no later than 7 days before departure; c) You pay the outstanding balance, as well as the fee for making changes in the amount of US $ 50 from each translator, as well as any additional fees, payments and other expenses associated with the translation; d) the recipient agrees to these booking conditions and all the terms of the Agreement between us.
4.3 You and the receiving party will be jointly and severally liable for the payment of all amounts. Otherwise, compensation will not be paid to passengers who are not traveling or for unused service.
4.4 Any discount you received upon initial booking may be changed or reduced upon making changes, if subsequently this discount has been changed, reduced or withdrawn.
4.5 If you paid the additional costs of living and the number of people in your accommodation will change, you may have to pay extra.
4.6 Any changes to your arrival date, transport, destination, accommodation or travel duration should apply to all participants in your reservation.
4.7 If you have purchased travel insurance, you may not be able to change or cancel it, and therefore any premium cannot be refunded.
5 If you cancel the order
If you or any member of your group cancel your trips at any time, we must receive a written notice from the person making the reservation by e-mail info@yoga-escapes.com. Since we bear the cost of canceling your trips, you must pay the following cancellation fees. The cancellation fee is a percentage calculated on the basis of the total costs payable by the canceler, is not refundable in case of cancellation.
If you cancel yoga retreat:
- 91 days or more before the date of your arrival: all payments will be refunded minus a 30% deposit. - Between 90 days and the date of your arrival: 100% of payments will be canceled.
For refunds, a fee of $ 50 is charged.
5.1. You have the right to cancel the travel agreement prior to departure without paying a cancellation fee in the event of “unavoidable and extraordinary circumstances” arising at or near your destination that significantly affect the implementation of the travel agreement or that significantly affect the transportation. arrangements to destination. 6 If we change or cancel your order
6.1 After confirming your reservation, we will make every effort to provide you with a booked trip arrangement. Sometimes it may be necessary to change or cancel all or part of your reservation.
We will notify you of any changes or cancellations as soon as we can.
6.2 Independent trips (e.g. flights, airport parking, car rental, etc.), which you can arrange separately, are not part of our contract with you. If changes are necessary to your travel agreement, we will not be liable for any changes or any cancellation fees incurred by you in relation to any such independent travel agreements.
6.3. If before the start of your trip we cannot control any of the main characteristics of your agreement before circumstances beyond our control, we will offer you either: (a) accept the amended agreements (b) accept the alternative agreement with comparable services from us if there are any (we will refund you any price difference if the alternative has a lower cost), or (c) cancel the reservation completely, in which case we will refund all the money paid by you, Please note that the above options are not available if any the change is minor. You must notify us within 7 days of receiving notice of significant changes if you want to: (a) accept the proposed change or (b) cancel the reservation and receive a refund.
If you have not notified us within 7 days, we will write to you again to receive confirmation of your choice from the above options.
If you do not respond within the next 7 days, we will cancel your order and refund you all payments made by you or on your behalf.
6.5 Please note that the compensation mentioned in clause 6.4 above and the options mentioned in clause 6.3 above do not apply to any minor changes made by us.
7 events beyond our control
7.1 Please note that compensation will not be paid, and we will not be liable, except that we offer you the options above, where:

8 Changes After Departure
8.1 If we are unable to provide a significant portion of the cost of the trip that you have booked with us after your departure, we will arrange for you alternatives, if possible, at no additional charge, and if necessary, we will pay you reasonable compensation.
8.2 A change of accommodation to an equivalent or higher standard is also not considered significant and does not make changes to your itinerary that do not have a significant impact on your trip.
9 minimum rooms
Some of the trips presented on our website can only be carried out if there is sufficient demand for them and if there are enough people booking these travel packages. In case of insufficient demand for subsequent confirmed orders, we have the right to cancel the trip in question. If we must do this, we will notify you as soon as possible. In this situation, you will have a choice: accept an alternative travel agreement, equivalent or close to standard. The cost of any alternative offer will be our selling price at the time of the change. If the alternative is cheaper, we will refund your difference. 10 Our responsibility to you
10.1 We agree to carry out and provide the trips that make up your reservation with reasonable craftsmanship and care. If your contract with us is not fulfilled or improperly executed by us or any of our suppliers, we will pay you appropriate compensation if this affected your enjoyment of the trip. We will not be liable for any failure to fulfill the contract with you if it is associated with:
a) through the fault of yourself and / or another member of your party;
b) a third party not associated with the provision of travel services and in the event of an unexpected or imminent failure;
c) unusual and unforeseen circumstances that we cannot control, the consequences of which could not be avoided, even if everything had been properly performed;
d) An event that neither we nor our suppliers, even with all due care, could have foreseen or prevented.
10.2 Our responsibility to you and any member of your group, with the exception of cases related to death, injury or illness, should not be more than three times the cost of your reservation. Our liability will also be limited in accordance with and / or in an identical manner:
a) The contractual terms of the suppliers we use to secure your trips form part of your contract with us. These conditions are included in this agreement as is;

11.2 If a yoga teacher, as a result of an injury, illness or personal need, cannot attend a yoga retreat and is forced to stop participating in a yoga retreat (including before the date of arrival) or must leave the yoga retreat early or cannot teach one or more classes during yoga retreat, we will do our best to find a replacement teacher. If as a result of this we cancel any yoga classes during the yoga retreat, we will not be obliged to reimburse the participants for any yoga classes, however we will do our best to compensate for these classes during the week. We reserve the right to change the appointed yoga teacher at the last minute under any circumstances, and we are not required to indicate the reason for the change of teacher.We reserve the right to change the time and schedule of yoga classes during yoga retreat. 11.3 If the organizer of the yoga retreat due to trauma, illness or personal need cannot attend the yoga retreat and must cancel his participation in the yoga retreat (including before the date of arrival) or must leave the Yoga Retreat early or must leave for some time during a yoga retreat, we will do our best to find a substitute organizer, or a yoga teacher will take on these responsibilities. We will not be liable for any refund as a result of this, but we will ensure that all logistics and plans are implemented and that yoga retreats continue to run smoothly.
12 Passport, visa, immigration and medical requirements
12.1. Passport and visa requirements for you and your group, as well as any other immigration requirements, are your responsibility, and you must check them at the relevant embassies and / or consulates before traveling. We do not accept any responsibility if you cannot travel, if you have not complied with the relevant requirements in force before and during the trip.
12.2. You are also required to check all required and recommended medical requirements, including vaccinations, before traveling and make sure that you receive all the necessary vaccination certificates and other medical records. The cost of obtaining any such documentation is your responsibility, and we cannot accept any responsibility or liability if your trip is affected by the inability to do so on your own or by any member of your group.
12.3 You must provide us with complete information about any existing medical condition or disability that could affect your trips (including but not limited to any accommodation requirements) at the time of booking. If, in our reasonable opinion, the conditions of the trip you have chosen are not suitable for your medical problem or disability, or you are not traveling with someone who can provide all the assistance that you may reasonably need, we have the right to refuse the reservation. 13 Health and Fitness
13.1 Activities within our holidays may require a certain degree of physical fitness. It is your responsibility to ensure that you have the levels of fitness required for any activity you choose to participate in. If you are in any doubt, please consult your doctor before departure. 14 Insurance
14.1. Before traveling, you should get the right insurance for all your needs. We cannot be held responsible for any costs that you may incur as a result of default.

14.3. If you take part in events organized and organized independently of us, you take part at your own risk and you must make sure that you have received the appropriate insurance.
15 Your duties and behavior on vacation
15.1 As part of your reservation with us, you accept responsibility for any loss or damage caused by you or any member of your group during your vacation. Payment for any loss or damage must be made to us or our supplier at the time this happens, or as soon as possible after that. 16 Tours and activities and resort information
Excursions, tours or other activities that you book or pay during your vacation are not part of the travel arrangements we provide. Your contract will be concluded with the operator or supplier of this excursion, tour or event, and not with us. We can help the group with information about the on-site excursion, but we are not responsible for the organization of the excursion, tour or event, as well as for everything that can happen in the course of its provision by the operator or taxi service. 17 local taxes and tourist taxes
If we have not stated that a local service or facility is included or free of charge in our accommodation description, you may be asked to pay a local fee, such as local tourist tax, room service (such as a minibar), wellness and beauty treatments, snacks, drinks and etc. Tourist taxes may be paid by you upon departure from the apartment.
18 Local Occupational Safety and Health Standards
You should be aware that the standards and requirements apply to the health and safety of the country in which the services are provided, and not the country from which you came. These standards may differ from the standards of the country from which you came, and sometimes lower.
19 Our website, brochure and advertising
The information contained on our website, in the brochure and in the promotional materials is our responsibility and, as far as we know, it is correct at the time of publication. 20 If you have a complaint
In the unlikely event that you have a reason to complain during your travel arrangements with us, you should immediately bring this to our attention. If your complaint is not resolved, you must repeat your complaint in writing within 28 days after the end of your trip by sending us an email at info@yoga-escapes.com. You must provide any booking reference and all other relevant information so that we can fully investigate your complaint. Any complaints that are not related to death, injury or illness and are not filed in accordance with this procedure, we are not responsible.
21 Data Protection
In order to process your reservation and ensure the smooth operation of your trips, we need to pass on the information that you provide to the appropriate suppliers, such as transfer companies, hotels, etc. The information we provide can also be provided for credit verification. companies and government agencies such as customs and immigration, if required by law. If your travel agreement is outside the European Economic Area (ELEA), data protection controls in your destination country may not be as strong as in the UK. However, we will not pass on your information to any person who is not responsible for part of your trips.
We will collect the name and telephone number of the emergency contact for you before each yoga retreat. We will use this information and contact this person only in case of emergency. We may share this person’s name and phone number with third parties, such as hotels, our yoga teachers, or healthcare providers (who may be located outside the UK / EEA) if necessary in an emergency. By providing us with this information, you agree to this disclosure. We can collect your contact information through the “Get in contact” form, the “Contact us” form, the reservation form and the participant form on our website, as well as from emails with requests sent directly to us and mailing list subscription requests .By providing us with your contact information, you agree that from time to time we may contact you with information about special offers or future yoga retreat packages. If you do not want to receive such information, please let us know. We will use your mobile number for the WhatsApp group, which we will create at the beginning of the yoga festival, to communicate with all members of the group. YOUR KEY RIGHTS UNDER THE RULES OF JOURNEY AND RELATED JOURNEYS 2018
The combination of travel services offered to you is a package in the meaning specified in the Rules of 2018 on travel packages and related trips.
In this way, you will enjoy all EU rights applicable to the packages. Vision Academy will be fully responsible for the proper operation of the package as a whole.
BASIC RIGHTS UNDER THE RULES OF TRAVEL AND RELATED JOURNEYS 2018
• Travelers will receive all the necessary information about the package before concluding a travel contract.
• There is always at least one trader who is responsible for the proper implementation of all travel services included in the contract.
• Travelers are given an emergency phone number or contact point information where they can contact the organizer or travel agent.
• Travelers may transfer the package to another person with reasonable notice and possibly at an additional cost.
• The price of a package can only be increased if specific costs increase (for example, fuel prices), and if it is expressly provided for in the contract, and in any case no later than 20 days before the start of the package. If the price increase exceeds 8% of the package price, the traveler can terminate the contract. If the organizer reserves the right to increase the price, the traveler has the right to reduce the price in the event of a reduction in relevant costs.
• Travelers can terminate the contract without paying any termination fees and receive a full refund of any payments if any of the main elements of the package, except for the price, has changed significantly. If, prior to the start of the parcel, the trader responsible for the parcel cancels the parcel, travelers are entitled to reimbursement and compensation if necessary.
• Travelers can terminate the contract without paying any cancellation fees before launching the package in case of exceptional circumstances, for example, if there are serious security problems at the destination that could affect the package.
• In addition, travelers may terminate the contract at any time before the start of the package in exchange for an appropriate and reasonable termination fee.
• If, after the launch of the package, significant elements of the package cannot be provided in accordance with the agreement, suitable options should be offered to the traveler at no extra charge. Travelers can terminate the contract without paying any cancellation fee if the services are not performed in accordance with the contract, and this significantly affects the performance of the package, and the organizer cannot solve the problem.
• Travelers are also entitled to a price reduction or compensation for damage, or both, if travel services are not or are not being properly performed.
• The organizer must provide assistance if the traveler is having difficulty.
• If the organizer or seller becomes insolvent, payments will be refunded.If the organizer or, where applicable, the seller becomes insolvent after the launch of the package, and if the package includes transport, the repatriation of travelers is ensured.
